With Notary Services Los Angeles Residents Avoid Ambiguity

By Eric Myers

The complexity of modern society and, consequently, the legal system means that no agreement, promise, undertaking or pledge can be seen as valid unless it is recorded, witnessed, filed and in some cases even served on the recipients. This is where notaries come in and this is why they are important officials in modern society. They perform a variety of functions that helps society to run more smoothly. Without reputable notary services Los Angeles residents will be at a loss.

Notaries evolved from the scribes in ancient Rome. These scribes did not just copy texts. They also recorded speeches and discussions, witnessed events and recorded judicial proceedings. Modern notaries do all these things and more. They are appointed by the government or by the high court, sometimes life long but often for a temporary period only, although appointments are often renewed repeatedly. Only those with an impeccable reputation are considered for this honour.

Certifying that copies of documents are true copies of the originals is one of the most common tasks performed by notaries. They also often administer oaths, when people swear that they will speak nothing but the truth and the whole truth. Breaking such an oath is a criminal offence and it is the duty of notaries to warn those swearing oaths that they will be guilty of perjury if they lie.

Taking down affidavits and depositions is another important task performed by notaries. Lawyers routinely ask them to do depositions in order to allow them to study the intended testimony of witnesses in a court case. If a witness in a case cannot, for some reason, personally testify, the court will sometimes allow a deposition to serve in the place of the testimony. To perform this task, some notaries take courses in short hand or stenography.

Businesses and even individuals often call upon notaries to act as official witnesses when they negotiate agreements. The role of notaries in such circumstances is to record the terms and conditions of the agreement, to make sure that all the parties understand them and to notarize the final documents. Once an agreement is properly notarized, it is very difficult to contest in court at a later stage.

When individuals or groups want an authoritative witness to an event they call upon notaries. Sometimes the courts, for example, order notaries to make sure that an order of the court has been obeyed, such as an instruction to repair a fence. People attempting world records often ask notaries to certify that all the rules were followed and that the attempt did in fact take place.

Notaries are obliged to keep detailed records of every single task that they perform in that capacity. The format of these records differs from country to country. These records serve as legal prove that a certain event has taken place, that a specific agreement has been made or that a specified person took an oath on a certain date for a specified purpose. The very existence of these records is enough to ward of disputes.

It is an honour to serve as a notary because only individuals regarded as morally strong, with unimpeachable integrity and a history for fairness and truth are considered. In any instance where they preside, their word is the final one. In a certain sense, notaries are the guardians of truth and fairness.
